Control AI (“Control,” “we,” “us,” or “our”) provides the Control web application, desktop software, and related services (collectively, the “Services”). By accessing or using the Services, you agree to these Terms of Service (“Terms”). If you do not agree, do not use the Services.
1. Eligibility and accounts
You must be legally able to enter a binding contract in your jurisdiction. You are responsible for the accuracy of registration information and for maintaining the confidentiality of your credentials. You must notify us promptly of any unauthorized use of your account.
2. Description of the Services
Control helps users describe tasks in natural language and may automate interaction with graphical user interfaces, applications, browsers, terminals, and connected cloud machines, depending on the product configuration you use. Features may include chat-based agents, workflow builders, remote viewing, and integrations with third-party AI model providers that you select or that we configure on your behalf.
The Services are not a substitute for professional advice (legal, financial, medical, or otherwise).
3. Your responsibilities
You agree that you will:
- Use the Services only in compliance with applicable laws and regulations.
- Obtain any rights, consents, and licenses needed for content you submit and for automation you run (including on third-party software and websites).
- Not use the Services to harm, harass, deceive, or defraud others; to violate intellectual property rights; to distribute malware; to attempt unauthorized access to systems or data; or to circumvent technical limits, billing, or security controls.
- Review and approve high-risk operations where appropriate (for example, irreversible data deletion, financial transactions, or changes to production systems).
You are solely responsible for how you configure automations, credentials, and connected machines.
4. Third-party services and models
The Services may interoperate with third-party identity providers, hosting providers, payment processors, and AI model APIs. Those services are governed by their own terms and privacy policies. We do not control third-party outputs and are not responsible for their availability or behavior.
5. Fees and trials
Paid plans, usage limits, and billing cycles are described at checkout or in your account. Unless stated otherwise, fees are non-refundable except as required by law. We may change pricing with reasonable notice where permitted.
6. Intellectual property
We retain all rights in the Services, branding, and documentation. Subject to these Terms, we grant you a limited, non-exclusive, non-transferable license to use the Services for your internal or personal business purposes during your subscription or access period.
You retain rights in content you provide. You grant us a license to host, process, and display that content as needed to operate and improve the Services (for example, running agents and storing session data according to our Privacy Policy).
7. Confidentiality and feedback
If we share non-public information about the Services with you, you will use reasonable care to protect it. If you provide feedback or suggestions, we may use them without obligation to you.
8. Disclaimers
THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. AUTOMATION AND AI SYSTEMS CAN ERROR; YOU ASSUME RISK FOR ACTIONS TAKEN ON YOUR SYSTEMS AND DATA.
9. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, CONTROL AI AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AND SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, GOODWILL, OR BUSINESS INTERRUPTION, ARISING OUT OF OR RELATED TO THE SERVICES OR THESE TERMS, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR AGGREGATE LIABILITY FOR CLAIMS ARISING OUT OF OR RELATED TO THE SERVICES OR THESE TERMS WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID US FOR THE SERVICES IN THE TWELVE (12) MONTHS BEFORE THE CLAIM OR (B) ONE HUNDRED U.S. DOLLARS (USD $100), IF YOU HAVE NOT PAID US.
Some jurisdictions do not allow certain limitations; in those cases, our liability is limited to the fullest extent permitted by law.
10. Indemnity
You will defend and indemnify Control AI and its affiliates against any third-party claims, damages, losses, and expenses (including reasonable attorneys’ fees) arising from your use of the Services, your content, your violation of these Terms, or your violation of others’ rights.
11. Suspension and termination
We may suspend or terminate access if you materially breach these Terms, create risk or legal exposure, or if we are required to do so by law. You may stop using the Services at any time. Provisions that by their nature should survive (including intellectual property, disclaimers, limitation of liability, indemnity, and governing law) will survive termination.
12. Changes
We may modify these Terms by posting an updated version or notifying you. If you continue to use the Services after the effective date, you accept the revised Terms. If you do not agree, you must stop using the Services.
13. Governing law and disputes
These Terms are governed by the laws of the jurisdiction Control AI designates for your contract, excluding conflict-of-law rules. Courts in that jurisdiction have exclusive jurisdiction, unless applicable law requires otherwise.
